Membership Terms and Conditions Issue 1
A. General Terms & Conditions
1. Each person who registers as a member of the Club´s online membership program
agrees to be bound by these Terms and Conditions.
2. To be eligible to register as a Member of the Membership Program, a person should be:
a. retired from EASA or
b. a former employee of EASA who is now retired
Note: the eligibility of other persons requesting Membership will be considered on a one by one basis.
3. Membership of the Membership Program is free.
4. Each Member is responsible for keeping their registration details, including postal and email addresses, up to date.
Failure to do so may result in that Member not receiving offers or other Membership benefits,
or suspension of the Member’s Membership Program account. Members may update their registration details by emailing the Club´s customer service desk at the email address listed on the Club website.
5. When registering as a Member of the Membership Program, a person may be prompted to:
a. ask for a login and/or
b. agree to data protection rules and/or
c. agree to publishing of the members email address, etc on the TERM Club website (only accessible to members who have logged onto the website). The Member should inform TERM Club, in advance, if they do not wish to have their email address, etc on the website.
6. Each Member acknowledges and agrees that all decisions pertaining to the Membership Program rest solely with TERM Club and its decision is final.
7. TERM Club gives no representation or warranty as to the continuing availability of the
Membership Program.
8. TERM Club reserves the right, in its absolute discretion:
a. to change or amend these Terms and Conditions;
b. to exclude a Member from the Membership Program or cancel a Member’s membership for any reason without prior notice (including if the Member fails to comply with these Terms and Conditions or supplies incorrect or misleading information); and
c. to modify, suspend, terminate or cancel the Membership Program in whole or in part without prior notice.
9. Members will be notifed of any changes to these Terms and Conditions or to the Membership Program. TERM Club will also update the revised Terms and Conditions on the Club´s website. The continued participation by the Member in the Membership Program will be deemed accepted by the Member unless the Member notifies TERM Club of their disagreement to the changes or revisions.
10. If TERM Club suspends, terminates or cancels the Membership Program, notice will be given to the Members by email.
11. Members may elect to cancel their membership of the Membership Program at any time by notifying TERM Club in writing or by emailing the Club´s customer service desk at the email address listed on the TERM Club´s website.
12. Any Member whose membership is cancelled by TERM Club, or who elects to cancel their membership, will no longer have access to offers or any other related benefits of the Membership Program.
13. To the extent permitted by law, TERM Club is not liable for any loss or damage suffered by a Member resulting from the amendment, withdrawal or cancellation of any offer or other benefit of the Membership Program in whole or in part, the exclusion or cancellation of a Member or a membership from the Membership Program or the modification, suspension, termination or cancellation of the Membership Program in whole or in part.
14. TERM Club accepts no liability whatsoever for any delays, disruption, omissions, errors, costs, expenses, loss, damage or injury whatsoever that may arise in any way from the Member’s participation in the Membership Program (including, but not limited to, the Member’s redemption or use of any offer).
15. Each Member indemnifies and keeps indemnified TERM Club against all claims, losses, damages, costs and expenses made against, suffered by or incurred by the TERM Club arising out of the Member’s participation in the Membership Program (including, but not limited to, the Member’s redemption or use of any offer).
16. The Terms and Conditions of the Membership Program are governed by and will be construed in accordance with the laws of the State in which the Club is situated, irrespective of where the application for membership has been completed and submitted by the Member.
Any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions or the Membership Program, unless otherwise agreed to by TERM Club, must be instituted and carried on only in the appropriate Court in the State in which the Club is situated.
17. Nothing in these Terms and Conditions affects any rights a Member may have which may not be excluded under any statute.
18. Each part of these Terms and Conditions operates to the maximum extent permitted by law. Any part of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective in that jurisdiction only to the extent of the prohibition or unenforceability. That does not invalidate the remaining content in these Terms and Conditions nor affect the validity or enforceability of that part of the Terms and Conditions in any other jurisdiction.
19. Any liability or duty arising from a Member’s participation in the Membership Program is the responsibility of that Member.
B. TERM Club Privacy Policy
1. TERM Club collects personal information of Members of the Membership Program
(eg name, gender, date of birth, email, address, phone number).
2. By registering to become a Member of the Membership Program, the Member consents to TERM Club using and/or disclosing the Member’s personal information for the following purposes:
a. administering the Membership Program (including to contact the Member in relation to the Membership Program by phone, email or post);
b. carrying out activities associated with the Membership Program; and
c. direct marketing activities (e.g distribution of e-newsletters and other publications) to the Member, and sending mobile push notifications and other communications to the Member, that TERM Club considers the Member may find interesting.
3. Members may access and update their personal information, or opt-out of receiving direct marketing communications, by emailing the Club´s customer service desk at the email address listed on the Club´s website.
4. To help improve, customise and optimise a Member’s user experience and for site administration purposes, TERM Club may use “cookies” or other available technology to learn more about user action on the Club´s website, to remember a Member’s preferences, to help authenticate Members and to collect information about Members’ use of the Club´s website. Cookies are small files that store information on your computer, mobile phone or other device. They enable the entity to put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions.
TERM Club may also use cookies to enable it to collect data that may include personal information and any such personal information will be handled in the same way as TERM Club handles all other personal information as described in TERM’s Privacy Policy.
5. Members can disable cookies through their internet browser but the Club´s website may not work as intended for a Member if it does so.
6. All personal information provided by Members, access to personal information (including seeking correction of personal information) and handling of complaints is managed under the TERM Club Privacy Policy. The TERM Club Privacy Policy contains information about how Members may complain about a breach of the Euopean Privacy Principles.
C. Data Protection Policy

2. Data protection principles
The TERM Club is committed to processing data in accordance with its responsibilities under the GDPR.
GDPR requires that personal data shall be:
a. processed lawfully, fairly and in a transparent manner in relation to individuals;
b. collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;
c. adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
d. accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
e. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and
f. processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.”
3. General provisions
a. This policy applies to all personal data processed by the TERM Club.
b. The Responsible Person shall take responsibility for the TERM Club‘s ongoing compliance with this policy.
c. This policy shall be reviewed at least annually.
4. Lawful, fair and transparent processing
a. To ensure its processing of data is lawful, fair and transparent, the TERM Club shall maintain a Register of Systems.
b. The Register of Systems shall be reviewed at least annually.
c. Individuals have the right to access their personal data and any such requests made to the TERM Club shall be dealt with in a timely manner.
5. Lawful purposes
a. All data processed by the TERM Club must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests.
b. The TERM Club shall note the appropriate lawful basis in the Register of Systems.
c. Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.
d. Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in the TERM Club‘s systems.
6. Data minimisation
a. The TERM Club shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
7. Accuracy
a. The TERM Club shall take reasonable steps to ensure personal data is accurate.
b. Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.
8. Archiving / removal
a. To ensure that personal data is kept for no longer than necessary, the TERM Club shall put in place an archiving policy for each area in which personal data is processed and review this process annually.
b. The archiving policy shall consider what data should/must be retained, for how long, and why.
9. Security
a. The TERM Club shall ensure that personal data is stored securely using modern software that is kept-up-to-date.
b. Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
c. When personal data is deleted this should be done safely such that the data is irrecoverable.
d. Appropriate back-up and disaster recovery solutions shall be in place.
10. Breach
In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, the TERM Club shall promptly assess the risk to people‘s rights and freedoms and if appropriate report this breach to the ICO (more information on the ICO website).
